Terms & Conditions

Wellshare Consulting Rooms Limited (registered in England No. 16190739). Our registered office is at 54 Quarry Street, Guildford, Surrey, England GU1 3UA (“the Owner” or “we”).

 

These are the terms and conditions under which a mental health therapist, physician, consultant, practitioner (“the mental health therapist, physician, consultant, practitioner” or “you”) can hire the use of a Consulting Room (“Consulting Room”) at 54 Quarry Street, Guildford, Surrey, England. Our Consulting Rooms are available for you to hire, to enable you to consult with any client or patient of yours (“Client” or “Clients”, “Patient” or “Patients”) in discrete surroundings to enable you to provide therapy and medical services.

 

 

To use any of our facilities and services (“the Services”) you are required to provide us with –

Basic information by completing a short online registration form. The form asks for contact information, including mobile telephone number, email address, your occupation and confirmation that you hold current professional indemnity insurance which is applicable to the treatment that you are providing to Patients or Clients.

 

 

We reserve the right to verify any professional qualifications and insurance.

By providing details to us, you agree that we may hold your personal information on our files and web-based records and use them as required for business purposes. This will be in accordance with our Privacy Policy which is linked to our website and can be viewed here.

 

After we have met you in person or online, you have completed the registration process and activated your online account, you can then book a Consulting Room.

 

 

Wellshare Consulting Rooms provides –

A secure Consulting Room for you to see your patients/clients.

 

We require that all clinicians, physicians and practitioners –

 

Leave the Consulting Room clean and tidy and in the same condition and configuration that you found it.

 

The Consulting Rooms and public areas are not used for any illegal or inappropriate purposes including but not limited to smoking, drug abuse, alcohol abuse, gambling, violent or threatening behaviour, or any other purpose that is likely to reflect negatively on the Owner or any other clinician, physicians or practitioner who use the premises.

 

You will not light or allow candles, incense sticks or naked flames, nor permit any unpleasant odours in the building.

 

We will not permit any animals in or on the premises with the exception of assistance and therapy dogs.

 

We only permit the use of oils in rooms with hard flooring.

 

The Consulting Rooms may only be used during the hours that have been booked and paid for.

 

We expect you to vacate the Consulting Room promptly at the end of your session in order to ensure that it is thoroughly checked and maintained to the required standard ready for the next practitioner, physician, clinician or consultant.

 

You should make sure that you switch off all lights and electrical equipment when leaving the Consulting Room and ensure that the door is securely closed.

 

 

Use of our premises

The staff on the premises are present for the purpose of maintaining the premises and ensuring a peaceful, professional environment. This includes managing risk and any issues that may arise.

 

Staff do not provide reception, administrative or any additional services such as providing refreshments for patients/clients or informing clinicians, physicians, and practitioners that their client/patient has arrived.

 

It is the responsibility of clinicians, physicians, and practitioners to collect their patient/client from Reception.

 

Abusive or disrespectful behaviour towards staff or any other person using the premises will not be tolerated.

 

The right to use an allotted Consulting Room for a specific period is granted by way of a personal, non-exclusive licence only. It does not create, and shall not be construed as creating, any tenancy, lease, security of tenure, exclusive right of possession or other proprietary interest in the Consulting Room or any part of the premises. The licence is personal to you and may not be assigned, transferred, or sublicensed.

 

Wellshare Consulting Rooms reserves the right to change the interior design, equipment, decoration, furniture, and/or fittings in the Consulting Room as and when necessary.

 

 

 

Consulting Room Allocation and Availability

Unless expressly agreed otherwise in a written agreement signed by Wellshare Consulting Rooms, all Consulting Rooms are made available on a non-exclusive and revocable basis.

 

Wellshare Consulting Rooms reserves the right, at its sole discretion, to withdraw, substitute, reallocate or otherwise make unavailable any Consulting Room that is not subject to a current written agreement granting exclusive or dedicated use to a practice or company.

 

The allocation of a particular Consulting Room, whether for a single booking or for repeated or recurring bookings, shall not confer upon any clinician, physician, practitioner, company or other user any contractual right, proprietary interest, licence, entitlement or legitimate expectation to the continued use of, or future access to, that Consulting Room.

 

Wellshare Consulting Rooms does not warrant or represent that any particular Consulting Room will remain available for future bookings. Room allocations may be varied from time to time where Wellshare Consulting Rooms reasonably considers it necessary for operational, commercial, maintenance, regulatory, health and safety or other legitimate business reasons.

 

No course of dealing, previous allocation, historical booking pattern or repeated use of any Consulting Room shall give rise to any contractual right or variation of these Terms and Conditions. No such right shall arise except pursuant to a written agreement executed by Wellshare Consulting Rooms expressly granting exclusive or dedicated use of a specified Consulting Room.

 

 

Personal Equipment and Property

Any equipment, materials, personal belongings or other items belonging to practitioners, physicians, clinicians, consultants or any other person using the Consulting Rooms, including but not limited to medical equipment, devices, records, documents and personal items, that are brought onto, left or stored at the premises are done so entirely at the owner’s own risk.

 

Wellshare Consulting Rooms Limited accepts no responsibility or liability for any loss, theft, damage, destruction or deterioration of any equipment, materials, personal belongings or other items left or stored on the premises, regardless of how such loss, theft, damage, destruction or deterioration occurs.

 

Practitioners, physicians, clinicians, consultants, or any other person using the Consulting Rooms remain responsible for ensuring that any equipment or belongings brought onto the premises are adequately insured and are suitable, safe and compliant for their intended use.

 

Wellshare Consulting Rooms Limited reserves the right to remove any items left on the premises where they are considered to be unsafe, inappropriate, abandoned or in breach of these terms and conditions.

 

 

 

Payment for Services

Services are to be paid in advance by debit/credit card, cash or bank transfer. The current tariff for our fees can be found on our website.

 

Fee increases will be announced formally by email providing information on the changes and the date when the new fees will take effect.

 

If you wish to cancel your booking, we require you to inform us at least 24 hours before the booking start time at which point we will refund you the fee paid for the booking you wish to cancel. Cancellations within the 24-hour window before the start of the booking cannot be refunded.

 

Insurance

We require you to have up-to-date insurance paid for at your own expense. This is to ensure that you have in place whatever insurance is reasonable in the circumstances which may include public liability, professional indemnity and any other indemnity insurance, to ensure that the Owner is fully protected against any loss, damage or other liability that we incur by providing Services to you.

 

We may also ask you to provide evidence of your insurance cover, and you should not see any Patient or Client at the premises without appropriate insurance cover in place.

 

It remains your responsibility to ensure that premiums are paid and all appropriate insurances are properly maintained.

 

For our protection

We expect you to fully indemnify us against any loss or damage that we suffer because you have been negligent or contravened any of your obligations under these terms and conditions or if any client or patient suffers any loss or damage either at the premises or as a result of services provided to them.

 

This indemnity also extends to any tax or National Insurance contributions in respect of any payment that you receive from a patient or client.

 

Photography and Advertising

To protect the privacy, branding, and integrity of our business, photography, video recording, or the use of any images of Wellshare Consulting Rooms, its premises, products, or staff for commercial or advertising purposes is strictly prohibited without prior written consent and approval of content from Wellshare Consulting Rooms management. If such permission is granted for use on websites, social media or marketing purposes, a visible backlink to the Wellshare website shall be provided.

 

It is strictly forbidden to photograph or video members of the public, patients, clients, staff, clinicians, tradesmen or any other person on the premises or entering or leaving Wellshare Consulting Rooms.

 

Intellectual Property – Images and Visual Content of Wellshare Consulting Rooms

 

All images, graphics, photographs, and other visual content displayed on the website of Wellshare Consulting Rooms, or shared through any online platform, social media channel, or other medium are the exclusive property of Wellshare Consulting Rooms. These materials are protected by copyright and intellectual property law.

 

No image or visual content may be copied, reproduced, distributed, modified, or otherwise used without the prior written consent of Wellshare Consulting Rooms. Unauthorised use, whether on websites, social media, or any other online or offline platform, is strictly prohibited.

 

 

 

Legal

Our terms and conditions form the basis of the legal agreement between us and the clinician, physician or practitioner renting a Consulting Room from Wellshare Consulting Rooms Limited. There are no exceptions to these terms and conditions unless it has been agreed in writing by one of our directors.

 

By making a booking with us, you are acknowledging that you understand our terms and conditions and the fact that the use of any Consulting Room will be subject to these terms and conditions, as well as the fact that we are not making any assurances as to the suitability of the Premises or their use by you.

 

We are also relying on specific assurances by you that: –

All your information including your accreditations is correct and up to date.

 

No Patient or Client has been told of qualifications, experience or accreditations that you do not in fact have.

 

Aesthetic practitioners carrying out non-surgical cosmetic procedures are required to hold a medical qualification and be registered with either the GMC, GDC or NMC.

 

You have all the necessary consents and approvals to provide Services to your Patients or Clients and that there is no pending investigation or proceedings that might adversely affect your ability to provide Services to Patients or Clients.

 

We reserve the right to terminate our agreement with you at our discretion by giving you 48 hours’ prior notice and refunding any advance payment for Services not yet used.

 

 

The agreement between us is governed by English law and any disputes can only be dealt with in the English Courts.
